RegisterFly Class Action Lawsuit Developments

The Dummit Law Firm was granted a Default Judgment against RegisterFly, Inc., Unified Names, Inc., Hosting Services Group, Inc., Kevin Medina and John Naruszewicz in Federal Court in the Middle District of North Carolina (1:07CV188). The Order granting Default Judgment was entered on 6 February 2009, awarding named Plaintiff Ms. Anne Martinez damages, which were statutorily trebled. Moreover, Defendants' were ordered to pay attorneys fees to The Dummit Law Firm. Since that time, The Dummit Law Firm has spent many hours and resources in an attempt to locate any assets that may be available to satisfy the judgment. To date, the judgment has yet to be collected. Unfortunately, due to the Default Judgment, the Judge did not grant Class Certification, which was pled in Plaintiff's Complaint. This effectively meant that our proposed class action was never going to get a chance to get off of the ground. As such, all of the proposed class of individuals never became legal clients of the Firm. Ms. Martinez, the sole named Plaintiff in the filed action was the Firm's only retained client. At this point, our Firm has made the difficult decision to no longer pursue any action against any of the original named Defendants.

The Dummit Law Firm would like to thank each and every person who contributed information, postings, records and documents regarding their experience with the above. As our Firm only legally represented Anne Martinez, any other person following this site still may have a claim against any or all of the Defendants and is encouraged to talk to an attorney of his or her choosing soon, before any applicable Statute of Limitations may run. Motion for Default Judgment filed against RegisterFly, Kevin Medina, UnifiedNames and Hosting Services Group. This differs from the Entry of Default entered by the Clerk of Court in that the Entry of Default simply establishes the time of the default, whereas the Default Judgment is a determination that the Plaintiff has won the action and is entitled to a remedy. Our Motion for Default Judgment is our request for this judicial determination.

ICANN announces agreement for GoDaddy.com to take over all generic top level domain names held by RegisterFly.

Enom files a motion to dismiss or transfer the class action lawsuit.

Friday April 27th 2007

California court grants a preliminary injunction giving ICANN the right to terminate RegisterFly's accreditation as soon as possible and requiring RegisterFly to post a notice of the pending termination on its website.

Tuesday April 17th 2007

RegisterFly has been ordered by US Federal Court Judge, Manuel J. Real, to hand over to ICANN current and accurate data for all of its domain names now that ICANN's application for a temporary restraining order (TRO) against RegisterFly was granted yesterday.

Also, in exciting news today, several of Anne Martinez's domains, including GoCertify.com, successfully transferred to another registrar after being properly recorded under her name once again. This is a great victory for this lawsuit, but is only the very, very beginning. The Dummit Law Firm fully intends to continue to pursue this case on behalf of Anne Martinez and everyone who was and still is being wronged by RegisterFly, ICANN, et al, and will continue to diligently work to this end. Expect to receive continued updates as this case moves forward.

April 11, 2007
Despite the fact that our District Court hearing scheduled for today was continued to another day at ICANN's request, coincidentally....something very positive did happen today. RegisterFly has finally corrected the domain ownership information on Anne Martinez's most important domain, www.GoCertify.com, returning it to her within their system. It remains to be seen if she can successfully transfer it away, but she is fervently working on that right now. They also provided authorization codes for 2 more domains Anne owns. She will feel more reassured when her domains actually successfully reside at another registrar, but meanwhile, this is a great sign that this lawsuit is having some effect. I will keep fighting for the rest of you.

ICANN refuses to help people even after having admitted that an emergency exists. ICANN filed a motion today to have the Injunction hearing scheduled April 11th 2007 here in North Carolina continued, and require those victims of RegisterFly still trapped to simply continue to sit in limbo with no help? Why won't ICANN join in to protect the public!
